AGREEMENT
Please read the following agreement and indicate that you agree to the terms:> ABC, AS USED HEREIN, REFERS TO ABC SPECIAL EVENTS, INC., ABC RENT-ALL, ABC HARDWARE AND RENTAL, INC. AND STRANSKY'S ABC HARDWARE & RENTAL EACH CORPORATION IS AN INDEPENDENT LEGAL ENTITY OPERATING SEPARATELY FROM THE OTHERS. The undersigned applicant ("Applicant"), and guarantor(s) ("Guarantor(s)") understand that in completing this Application, he/she/it is applying for credit from all of the above-referenced corporations and is responsible for payment to those corporations. The undersigned also acknowledges that a credit account with one or more of the above-referenced corporations may be assigned to ABC Hardware and Rental, Inc. for collection. The Applicant, and Guarantor(s) if any, jointly, severally, personally and unconditionally agree(s) and guarantee(s) the payment when due of all of the indebtedness of the Applicant to ABC (the "Indebtedness"), however and whenever the Indebtedness arises, and the Applicant and Guarantor(s) agree(s) to pay all expenses, including reasonable attorneys fees, index number fees, court costs, filing fees and other disbursements and expenses incurred by ABC to collect upon or enforce this agreement against Applicant or Guarantor(s). Guarantor(s) hereby waive(s) presentment, demand, notice of acceptance, notice of the creation of any Indebtedness, all demands and notices of any kind in connection with this guarantee or the Indebtedness, and all diligence in collection or protection of or realization upon any kind of Indebtedness. ABC may, without notice to or consent of the Guarantor(s), and without in any way affecting the Guarantor's(s') liability under this guarantee, alter, accelerate, extend, renew, or change the time, place, manner, or terms of payment of, any or the Indebtedness, or compromise or release any liability of Applicant or any of the Guarantor(s) or any other party or parties primarily or secondarily liable on any of the Indebtedness, apply any sum received by ABC from the Applicant or from any other source applied to the Applicant's obligations in such a manner as ABC determines, or resort to any or all of the Guarantor(s) for payment of some or all of the Indebtedness whether or not ABC shall have first proceeded against the Applicant, any of the Guarantor(s), or any other party primarily or secondarily liable on any of the Indebtedness. This Application is signed and the undersigned affirm(s) under penalty of perjury that all of the information given in this Application is true and accurate to the best of the undersigned's knowledge.
